Employment and the 457 visa
If you are a business owner struggling to find appropriately skilled employees, or if you live overseas and wish to migrate to Australia, a 457 visa may be the solution. Navigating the visa process can be confusing and heavy with paperwork and jargon – YML Group offers migration business services to assist you through this process.
What is a 457 visa?
This particular class of visa is reserved for skilled temporary work. If you are eligible for a 457 visa, you will be allowed to work in Australia for up to 4 years. It’s important to understand that you must be sponsored by your employer under this visa class.
If you’re an employer, your business may be eligible to sponsor someone on a 457 visa if your business has not been able to find an Australian citizen or permanent resident to fill a skilled role.
The application process
There are a number of key requirements that must be filled by both potential employees and potential employers in order to be eligible for a 457 visa – or to sponsor someone on a 457 visa. Firstly, as an individual, you must be working in an approved occupation as defined by the Australian Government. Information on whether your occupation meets the criteria is available through a migration agent or the Australian Government . In addition, you must meet skill and language requirements, and have been nominated by an approved business (i.e. a business approved for employment and sponsorship of 457 visa holders). You may be required to complete a skills assessment.
There are also key requirements that businesses must meet in order to become a sponsor. The business owner(s) must be able to prove that their business operates lawfully, and demonstrate a strong commitment to non-discriminatory recruitment practices. The business should also be able to show they are willing and committed to employ local labour (i.e. local employees) where the expertise and skills are available. In addition, the business takes on a number of obligations when it becomes a sponsor. These may include:
- Appropriate record keeping
- Inspection cooperation
- Provision of training
- Payment of travel costs in adverse situations
- Confirm the 457 visa holder is participating in the nominated occupation
